Campus: St. George (Downtown Toronto)Description:Course Number and Title: CRI422H1F Indigenous LawCourse description:This course explores Indigenous law, settler state law as it applies to Indigenous peoples, and various facets of the complex interrelationship between the two in Canada’s multijuridical legal order. Indigenous law is both a long-established and evolving area of knowledge, study, practice and lived experience. The first part of the course is dedicated to considering the sources, forms, and processes of Indigenous law as a vital and dynamic legal tradition. This necessarily also requires that we reconsider what we think we know about the sources, forms and processes of settler state law. In the second and third parts of the course, we will critically examine the relationship between Indigenous law and other legal traditions in Canada, from the roots of the constitution to the modern law of Aboriginal rights and beyond. Our premise is twofold: first, that Indigenous law is always already part of the Canadian legal order; and second, that decolonization requires not merely recognizing Indigenous law but fundamentally reimagining and restructuring the relationship between Indigenous and other legal traditions. We will conclude by reflecting on what we have learned, what we still need to learn, and how we might continue to develop our knowledge and understanding.Estimated course enrolment: 55Estimated TA support: noneClass Schedule: TH:17:00-20:00 (In-Person)*Please note, the delivery method for this course is currently In-person. Seminar instruction and facilitation. Student correspondence and consultation (i.e., office hours, etc.).
